A Manhattan woman tripped and fell on a raised sidewalk in front of a brownstone, sustaining a broken nose and torn wrist ligament. During discovery, we learned that the sidewalk defect was on the border of two different buildings, and that for years prior to the accident, they had discussed who was responsible for its repair, but never actually fixed it. Following depositions, the case settled for $150,000.00.
A Bronx woman slipped and fell on a wet floor as she was coming out of an elevator. The building owner claimed they had wet floor signs placed all over the halls. However, one of the employees deposed admitted he had gotten off the elevator with the injured woman, and saw no signs until after the accident. The woman sustained a torn rotator cuff in her shoulder, which required an operation and therapy. The case settled for $175,000.00.
A Bronx man was assaulted by two muggers in front of his girlfriend’s building in the middle of the night. He sustained a broken leg, which required several operations. The lawyers for the building claimed the injuries were caused by the muggers, based on a statement the injured man gave to the police when he was in an ambulance on his way to the hospital. The injured man claimed that he was fleeing from the muggers when he tripped and fell over a raised sidewalk flag which had existed in front of the building for years. He claimed he was dazed when he spoke to the police. The case settled for $200,000.00.
A Bronx woman slipped on garbage on the steps in her building, sustaining a torn ligament in her knee requiring surgery. The building claimed they had no notice of the garbage. We located a tenant in the building who testified that garbage on the steps was a recurring problem. The case settled for $175,000.00.
A Bronx woman tripped and fell on a piece of construction debris outside a construction site in NYC, fracturing her wrist. We were able to show that the debris was caused by the construction company’s failure to inspect their garbage trucks as they were removing the debris from the site. The case settled for $175,000.00.
An elderly Brooklyn woman slipped and fell on freshly mopped steps in her building. She sustained a back injury and dropped foot, causing her to walk with a slight limp. The son of the superintendent claimed the floor had dried by the time the woman fell. The case settled for $225,000.00.
A Queens man slipped and fell on an icy street in the Bronx, breaking his ankle. Normally, there is no claim against anyone for ice in the street, but in this case, through extensive discovery, we were able to locate a pipe extending through te curb, about 10 feet from where the man fell. According to a witness, the pipe produced water the night before, which froze as it traveled down the street towards the sewer. We were able to trace the pipe back to a building, and through the building, up to its roof, where water from the roof was drained. We sued the building, who settled the case during the trial for $250,000.00.
A 12 year old boy from Brooklyn tripped and fell over a protruding tree root while playing in an organized league football practice. As is common, the football league claimed the boy knew the risk of playing a dangerous sport such as football, and therefore were not responsible for his injury, which was a broken leg. We were able to show that on this particular occasion, the coach had told the team to practice in an area other than the regular field, and that he failed to inspect the area, which was near trees, for protruding roots. The case settled for $225,000.00.
